    這本由喬·肖編著的《歐盟法》(第三版)是一本為法學(xué)、政治學(xué)學(xué)生
    提供的學(xué)習(xí)歐盟法的入門教科書(shū)。與同類的教科書(shū)相比,本書(shū)有以下
    幾個(gè)特點(diǎn):
    1.通俗、簡(jiǎn)明、視野開(kāi)闊。歐盟法是一個(gè)自成一類的法律體系,突
    破了傳統(tǒng)的國(guó)際法與歐洲國(guó)內(nèi)法的界限。要學(xué)習(xí)、研究好歐盟法,不但
    要求具備國(guó)際法和歐洲國(guó)內(nèi)法的知識(shí)和訓(xùn)練,還需對(duì)歐洲的政治、經(jīng)
    濟(jì)、社會(huì)、文化等各方面有所了解,否則不易理解法律規(guī)則背后的東西
    和規(guī)則產(chǎn)生的原因。在這一繁復(fù)的知識(shí)領(lǐng)域面前,本書(shū)作者沒(méi)有故作
    高深,而假定讀者事先沒(méi)有受過(guò)任何歐盟法的訓(xùn)練,從而以通俗的語(yǔ)言
    介紹和解讀歐盟法。同時(shí),作者并未就條文談條文,而將法律條文放到
    更廣闊的政治、經(jīng)濟(jì)、社會(huì)和文化大背景下進(jìn)行分析。
    2.資料翔實(shí)、精煉。從1951年歐洲煤鋼共同體成252今,歐洲一
    體化已經(jīng)走過(guò)五十多年曲折、艱苦的歷程。在這個(gè)過(guò)程中,學(xué)術(shù)界起到
    了很大的推動(dòng)作用,各種學(xué)術(shù)研究成果浩如煙海。本書(shū)在選取主要參
    考書(shū)目與文章時(shí),顯然頗費(fèi)心思——精心選擇了大量1990年代以后優(yōu)
    秀學(xué)者的代表著述,并收錄了部分1990年代以前這一領(lǐng)域不可不提的
    經(jīng)典,例如P.Pescatore在1983年發(fā)表的“TheDoctnneOf‘Direct Ef-
    fect’:Anlnfant Disease in Community Law"。另外,歐盟法網(wǎng)上資源十
    分豐富,本書(shū)許多章節(jié)都附有主要的查閱網(wǎng)址。
    3.重點(diǎn)放在歐盟憲法和行政法。歐盟法基本可以分為三大部分:
    憲法和行政法、經(jīng)濟(jì)法和對(duì)外關(guān)系法。本書(shū)主要研究和討論的是歐盟
    憲法和行政法方面的問(wèn)題。作者假定該書(shū)的讀者多數(shù)來(lái)自英國(guó)和其它
    歐盟成員國(guó),他們最關(guān)心的問(wèn)題正是關(guān)系到歐盟成員國(guó)及其國(guó)民切身
    利益的憲政問(wèn)題。
    值得一提的是,學(xué)習(xí)、研究歐盟法的一個(gè)困難是它的時(shí)效性較強(qiáng)。
    夸張一點(diǎn)說(shuō),今天是法,明天一覺(jué)醒來(lái)就可能不再是法。這是由于歐洲
    一體化本身的發(fā)展所致。學(xué)習(xí)、研究歐盟法應(yīng)當(dāng)在教材的基礎(chǔ)上,十分
